The note is a clinical record signed by a licensed clinician. AI drafts the text; the clinician's review and signature is what makes it the legal record. No jurisdiction currently prohibits AI-assisted documentation for licensed mental-health work.

Consent to recording is a separate legal question. Every US state and most jurisdictions require at least one-party (and often all-party) consent to record. Verbal on-tape consent at the start of session is the minimum bar.

Insurance and Medicaid audits treat AI-drafted notes the same as any other note — the medical-necessity language, specificity to the client, and correct billing codes are what auditors evaluate.
