Do clients need to consent to AI scribe recording?
Verified Re-verified quarterly
Consent has two layers: legal (recording law in your jurisdiction) and clinical (client understanding what the recording is used for). Both are important.
Legal: 12 US states require all-party consent; the rest require one-party. Canada, UK and Australia effectively require client consent for clinical recording. Verbal on-tape consent is legally sufficient in most cases; written consent is stronger and easier to prove.
Clinical: explain what the scribe does, that audio is deleted after note generation, that the note is drafted by AI and reviewed by you, and that they can withdraw consent at any time. Reported consent rates in the field are >90% when framed clearly.
